         NOTE:  These represent only a few of the many cases which the Office of Jefferson County Commonwealth's Attorney is handling.  If you have any comments, or need further information concerning these or any other matters please do not hesitate to call.

                       

       An indictment is only an accusation.  A defendant is presumed innocent until or unless found guilty.  The enclosed court actions are subject to change.

                       

       According to the Rules of Criminal Procedure (RCr 3.02, 3.05, and 8.01) the arraignment of individuals whose case has been submitted directly to the grand jury shall take place as reasonably soon as possible.  If you are interested in a case that has been submitted directly to the grand jury, you must contact the court division in which it has been assigned to obtain the time and date of the arraignment.   

 

 

ARRAIGNMENT

 

  1. Marshall C. Smith III - 12CR2553 (Theft by Failure to Make a Required Disposition of Property Over $10,000 [12 cts], Theft by Failure to Make a Required Disposition of Property Over $500 [2 cts], Defrauding a Secured Creditor Over $100 [3 cts]) Mr. Smith  (DOB 5/23/57) , President of MCS Enterprises, dba “Tinker Toys”, a local RV dealership has been charged with failing to pay owners of RV’s sold on consignment, failing to make payoffs on trade-ins, and failing to transfer several sold RV’s  The amount stolen exceeds $300,000.  This case was investigated and charged by the Attorney General’s Office as a result of consumer complaints filed with that office.  Arraignment is scheduled for Monday August 27, at 2:30 P.M. in Division 11.  Jeff Cooke is the prosecutor.

 

 

HEARING

 

  1. Susan Kay Lukjan – 09CR0440.  Ms. Lukjan (DOB 8/7/63) was found guilty of Arson 2nd Degree, Burning Personal Property to Defraud Insurer and Fraudulent Insurance Acts >$300 in connection with the August 19, 2006 fire at Campbell’s Gourmet Cottage then located at 127 N. Sherrin Ave.  The Defendant’s case has been sent back to circuit court for a new trial.  A hearing to determine the reliability of expert testimony is scheduled for Monday August 27, at 1:00 P.M. in Division 13.    Leland Hulbert and Josh Schneider are the prosecutors.

 

 

PRE-TRIAL CONFERENCE

  1. Richard Biscomb – 12CR0347(Complicity to Burglary Second Degree [15 counts] counts, Fleeing or Evading Police First Degree (Motor Vehicle), Receiving Stolen Property Over $500, Illegal Possession of a Controlled Substance in the First Degree, Persistent Felony Offender in the Second Degree) Mr. Biscomb (DOB 10/07/75) is charged in connection with a large string of burglaries over the past six months in several areas of Metro Louisville, including St. Matthews, The Highlands, and Indian Hills. He is charged with 15 counts but is being investigated for breaking into over 100 residences during that period.  A Pre-Trial Conference is scheduled for Monday August 27 at 8:45 A.M. in Division 9.  Nick Mudd is the prosecutor.  Mr. Biscomb also has the following pending indictment: Richard Biscomb – 12CR1492Burglary Second Degree [FIFTY COUNTS]  Mr. Biscomb (DOB 10/07/75) is charged in connection with a large string of burglaries over the past several months in several areas of Metro Louisville, including St. Matthews, Prospect, The Highlands, Indian Hills, and Anchorage. A Pre-Trial Conference is scheduled for Monday August 27 at 9:00 A.M. in Division 6. Nick Mudd is the prosecutor.
  2. Dacia Greene (DOB 10/24/83) / Marcus Greene (DOB 8/7/80) / Zachery Kilgore (DOB 2/21/76) / Vickie Ramsey (DOB 1/1/59) / Laquita Townsend (DOB 7/18/80) – 09CR3501.  (M. GREENE, KILGORE, TOWNSEND: Murder [2 Counts], Assault 1st Degree, Burglary 1st Degree, Wanton Endangerment, Tampering with Physical Evidence; M. GREENE, D. GREENE: Illegal Possession of a Controlled Substance; M. GREENE; Possession of a Handgun by a Convicted Felon; RAMSEY: Tampering with Physical Evidence)  The defendants are charged in connection with the November 12, 2009 shooting deaths of Steve Wood, Jr. and Diana Wood in an apartment complex in the 4600 block of Tipsy Circle.  A Pre-Trial Conference is scheduled for Monday, August 27, at 10:00 A.M. in Division 9.  Mark Baker and Alice Jones are the prosecutors.
  3. Timothy R. Hauss – 12CR2190  (Wanton Endangerment First Degree [6 cts], Criminal Mischief in the First Degree, DUI 2nd Offense, Failure to Stop and Render Aid) Mr. Hauss (DOB 6/13/63) is charged in connection with operating a vehicle on or about February 25, 2012 that was involved in an accident with another vehicle with five occupants near Outer Loop.  Mr. Hauss allegedly fled on foot without rendering aid.    Mr. Hauss has a previous DUI from 2007.  A Pre-Trial Conference is scheduled for Tuesday August 28, at 9:15 A.M. in Division 13.  John Balenovich is the prosecutor.
  4. Gary W. Green 12CR1141. (Burglary in the Second Degree [6 cts], Fraudulent Use of a Credit Card, Fleeing or Evading Police, Criminal Attempt Burglary in the Second Degree, Persistent Felony Offender in the First Degree) Mr. Green (DOB 3/2/82) is charged in connection with home burglaries in the following locations: The 5000 block of Hickman Court and the 100 block of Westwind Road in the Indian Hills neighborhood;  the 1500 block of Old Harrods Creek Road , the 700 Block of Linden Drive, and the 11000 block of Willow Lane in the Anchorage Neighborhood; and the 2000 block of Woodford Place in the Highlands neighborhood.  The defendant is also charged with an attempted burglary in the 8000 block of Harrods view Court in the Prospect neighborhood.  The alleged offenses occurred between August 2011 and October 2011.  On or about October 24, 2011 Mr. Green fled from officers on foot at Cash America.  He was caught at Wildwood Country Club after the foot pursuit.  A Pre-Trial Conference has been scheduled for Tuesday August 28, at 9:15 in Division 6.   5. Thomas Lynch – 12CR1102.  (Rape First Degree, Sodomy First Degree [2 cts], Sexual Abuse First Degree [2 cts], Sodomy in the Second Degree) Mr. Lynch (DOB 6/7/64) is charged in connection with the sexual abusing and molesting of his seven year old step- granddaughter.  This alleged abuse occurred from 2005-2011 while she was between the ages of 7 and 13.  Over the years the suspect allegedly rubbed the victim's breast, digitally penetrated her, performed oral sex on her and ejaculating on her.  A Pre-Trial Conference has been scheduled for Wednesday August 29, at 9:15 A.M. in Division 2.  Sara Farmer is the prosecutor.
  6. Alfonso J. Cowan Jr - 12CR1246. (Wanton Endangerment in the First Degree [5 cts], Possession of  Handgun by a Convicted Felon [2 cts], Assault in the First Degree, Violation of a Pretrial Order of Release [2 cts], Persistent Felony Offender in the First Degree)  Mr. Cowan (DOB 5/9/73) is charged in connection with events occurring on or about February 27, 2012.  at Club Cedar, Mr. Cowan allegedly  started a verbal altercation and punched a victim in the face. He then produced a handgun and fired multiple shots at the victim and a female.  One round struck the victim in the arm shattering his humerus and causing nerve damage.  There were other people inside Club Cedar when he fired the gun.  A Pre-Trial Conference has been scheduled for Wednesday August 29, at 10:00 A.M. in Division 9. Jennifer Murzyn is the prosecutor.
  7. Brian D. Edmonds – 12CR0097. (Murder [2 cts], Tampering with Physical Evidence) Mr. Edmonds (DOB 8/5/93)  is charged in connection with the December 10, 2011 shooting death of Curtis Smith and Deshone Henry near the 1500 block of Beech Street.   Arraignment was previously held on January 12, 2012 and a bond was set at 500,000.  A Pre-Trial Conference has been scheduled for Friday August 31, at 10:00 A.M. in Division 4.  Frank Dahl is the prosecutor
  8. George Gonzalez – 09CR3269  (Murder, Burglary 1st Degree, Wanton Endangerment 1st Degree [2 cts] Mr. Gonzalez (DOB 10\15\88) was previously sentenced to 70 years in prison after a jury trial on a previous murder case back in July of 2011 09CR2528.  In this current case he is charged in connection (DOB 6/7/64) is charged in connection with a cold case murder on or about February 7, 2008 at 216 S. 21st St.  Two unknown males and a female entered the apartment. One of the unknown males produced a handgun and shot the victim twice. The victim died as a result of the wounds sustained from the shooting. The suspect fled the location along with the other unknown male & female.  On 10/23/09 detectives received information the suspect in this murder could positively identify the defendant as the suspect.  A Pre-Trial Conference has been scheduled for Friday August 31, at 9:15 A.M. in Division 3.  Lisa Cartier-Giroux is the prosecutor.

 

TRIAL

 

  1. Kewan Tyshawn Hackett – 11CR0222.  (Murder, Criminal Attempted Murder, Assault 1st Degree, Intimidating a Participant in the Legal Process, Tampering with Physical Evidence)  Mr. Hackett (DOB 5/27/73) is charged in connection with the January 8, 2011 shooting death of Kristen Redmon in a parking lot in the 3400 block of Breckenridge Lane.  A trial is tentatively set to begin Tuesday August 28 at 10:00 A.M. in Division 12.  Angela Johnson is the prosecutor.
