Today the Jefferson County Grand Jury returned an indictment against Louisville attorney Andrew Clooney arising out of a scheme which took place between July 2015 and August 2018 wherein Clooney is alleged to have settled personal injury cases without the knowledge or authorization of his clients and then stole all or part of the settlement proceeds.  Clooney, Christel Clooney, his wife, and Marlene B. Estrada, a Clooney employee, were all indicted on seven counts of Theft By Failure To Make Required Disposition of Property Over $10,000, nine counts of Theft By Failure To Make Required Disposition of Property Over $500 But Less Than $10,000 and nineteen counts of Criminal Possession of a Forged Instrument in the Second Degree.  The forgery charges result from the defendants having allegedly forged clients’ signatures to settlement agreements and Estrada fraudulently notarizing those signatures. The defendants face a maximum penalty of twenty years in prison.

The case has been assigned to Division Twelve of Jefferson Circuit Court and the three defendants are expected to be formally arraigned there on Monday, June 3, 2019 at 3:00 p.m.   Assistant Commonwealth’s Attorney Doug Meisel is the prosecutor.

According to the Rules of Criminal Procedure (RCr 3.02, 3.05, and 8.01), the arraignment of individuals whose case has been submitted directly to the grand jury shall take place within a reasonable time after the return of an indictment. If you are interested in a case that has been submitted directly to the grand jury, then please contact the court division in which it has been assigned to obtain the time and date of the arraignment.

SIGNIFICANT EVENTS

Isaiah Marquette Nelson – 19CR1390 (Murder)

  • Mr. Nelson (DOB 05/11/99) has been indicted for the murder of Justice Smith, which occurred on May 3, 2019.  Arraignment will occur on Tuesday, May 21, 2019 at 9:00 a.m. in Division 1 of Jefferson Circuit Court. Kristi Gray is the prosecutor.

Anthony Wayne Trice – 19CR1384 (Murder, Criminal Abuse in the First Degree)

  • Mr. Trice (DOB 06/25/92) is charged with the abuse and Murder of his one month old son on May 5, 2019. The defendant was arraigned on Friday, May 17, 2019 and a first Pretrial Conference is scheduled for July 11, 2019 at 10:30 a.m. in Division 5 of Jefferson Circuit Court. Madison Shoffner is the prosecutor. 

PRETRIAL CONFERENCES

Tamara L. Eubanks – 18CR1912 (Murder)

  • Ms. Eubanks (DOB 01/07/83) is charged with the June 24th, 2018 Murder of her former boyfriend, Jaqua Simmons, in her home. A pretrial conference is scheduled for May 20, 2019 at 8:30 a.m. in Division 7 of Jefferson Circuit Court. Madison Shoffner is the prosecutor.

HEARINGS

Troy Antwan Hurt, Jr. – 17CR0648 (Murder)

  • Mr. Hurt (DOB 10/06/00) pleaded guilty in February to the November 9, 2016, murder of his romantic partner Trayona McDowell (DOB 10/17/98) whom he believed was pregnant with his child.  Prior to being sentenced, Mr. Hurt moved to set aside his plea.  A hearing on this issue is scheduled for May 20, 2019, at 10:00 a.m. in Division 12 of Jefferson Circuit Court.  Elizabeth Jones Brown is the prosecutor.
