According to the Rules of Criminal Procedure (RCr 3.02, 3.05, and 8.01), the arraignment of individuals whose case has been submitted directly to the grand jury shall take place within a reasonable time after the return of an indictment. If you are interested in a case that has been submitted directly to the grand jury, then please contact the court division in which it has been assigned to obtain the time and date of the arraignment.

ARRAIGNMENT

Allen Lehmann and Verna Lehmann – 16CR1394 (Rape in the First Degree, Sodomy in the First Degree [Three Counts – Allen Only], Sexual Abuse in the First Degree [Nine Counts- Allen], Facilitation to Rape in the First Degree, Facilitation to Sodomy in the First Degree [Three Counts- Verna Only], Sexual Abuse in the First Degree [Three Counts- Verna Only])

  • Mr. Lehmann (DOB 6/8/38) was previously charged with nine counts for sodomizing and sexually abusing three girls under the age of twelve under indictment 14CR1393.  The Grand Jury returned true bills on twenty counts on May 26, 2016, adding four additional counts against Allen Lehmann and adding his wife, Ms. Lehmann (DOB 4/15/1938).  Ms. Lehmann is charged with seven counts for her involvement in the rape, sodomy, and sexual abuse of the three victims.  A status hearing is scheduled for Friday, June 3, 2016 in Division 1 at 10:30 where Ms. Lehmann is also expected to be arraigned.  Courtney Straw is the prosecutor.

PRETRIALS

Stuart Cox – 16CR0838 (Murder-Domestic Violence)

  • Mr. Cox (DOB 05/04/91) is charged in connection with the shooting death of Tracey Brock, Mr. Cox’s girlfriend. On Wednesday, June 01, 2016 at 1:00 p.m. in Division Eight of the Circuit Court, a pre-trial conference is scheduled.  Nathan Ray Batey II is the prosecutor.

Timothy Shockely – 16CR0492 (Robbery in the First Degree, Convicted Felon in Possession of a Handgun, Tampering with Physical Evidence, and Illegal Use or Possession of Drug Paraphernalia)

  • Defendant Shockley (DOB 2/25/1989) is charged in connection with the July 13, 2016 carjacking of James Watson at 4300 Crittenden Drive. A pre-trial conference is scheduled for June 2, 2016 at 9:00 in Division Three.  Shelly Alvey is the prosecutor.

Russhawn D. Townsend – 16CR0155 (Assault in the First Degree, Assault in the Second degree, Persistent Felony Offender in the First Degree)

  • Mr. Townsend (DOB 10/12/83) is charged in connection to an assault that took place in the early morning hours of January 1, 2016, at the White Castle on Bardstown Road near Hikes Lane.  The defendant and an unknown complicitor brutally assaulted Vadim Tolstykh and Nikolai Rueta.  Mr. Tolstykh was kicked repeatedly in the head while he was unconscious on the ground, which left him with severe brain damage and unable to move or talk to this day.  It is alleged that Mr. Townsend and his unknown complicitor beat their victims for being Russian immigrants.  A Pre-Trial Conference is scheduled for Tuesday, May 31st at 2:00 p.m. in Division 1 of Jefferson Circuit Court. Alex Gaddis is the prosecutor.

Judy Hiser –15CR2266 (Facilitation of Rape in the First Degree [Seven Counts], Facilitation of Incest [Seven Counts], Facilitation of Sodomy in the First Degree [Four Counts], Facilitation of Unlawful Transaction with a Minor in the First Degree, and Facilitation of Use of a Minor in a Sexual Performance)

  • Ms. Hiser (DOB 1/23/78) is charged in connection with child sex abuse involving Mr. Larry Wayne Lewis and Ms. Hiser’s minor children. A pre-trial conference is set for Wednesday, June 01, 2016, at 9:45 A.M. in Division Ten of the Jefferson Circuit Court. Nathan Ray Batey II is the prosecutor.

Aron Ballard and Anthony Foster – 16CR1051 (Murder, Criminal Attempt Murder, Wanton Endangerment in the First Degree [Six Counts])

  • Ballard (DOB 12/18/93) and Foster (DOB 9/30/90) are charged in complicity in relation to a shooting that occurred on April 2, 2016 at 2129 Bolling Avenue. The defendants fired multiple shots at the victims, Lottie Eicher and Rodriq Buchannon, in an attempt to kill these individuals.  As a result of the defendants’ actions, Rodriq Buchannon was shot multiple times and suffered serious physical injury.  Lottie Eicher was also shot and died as a result of her injuries.  2129 Bolling Avenue was occupied by six persons, who were all on the first floor of the house when the defendants were shooting.  A Pretrial Conference is scheduled for Wednesday, June 1, 2016 at 9:00 a.m. in Division 2 of Jefferson Circuit Court.  Emily Cecil is the prosecutor.

Quinton Elliott and Dalesha Smith –16CR1085 (Complicity to Assault in the First Degree, Criminal Abuse in the First Degree, Criminal Abuse in the Second Degree, and Persistent Felony Offender in the Second Degree [Elliott Only])

  • Mr. Elliott (DOB 10/27/92) and Ms. Smith (DOB 11/06/90) are charged in connection with child physical abuse involving Ms. Smith’s minor child. The allegations include a water burn to the child’s bottom, punching the child in the stomach, stepping on his stomach, and hitting him in the head with a spoon. A pre-trial conference is set for Thursday, June 02, 2016, at 9:30 A.M. in Division 9 of the Jefferson Circuit Court. Nathan Ray Batey II is the prosecutor.

Percy A. Phillips – 09CR3016 (Murder, Robbery in the First Degree)

  • Mr. Phillips (DOB 08/01/64) is charged in connection with the murder of Brenda Whitfield on September 28th, 1993.  A pre-trial conference is scheduled for Friday, June 3rd at 9:00 a.m. in Division One.  Shelly Alvey and Milja Zgonjanin are the prosecutors.

Samuel Barrett – 16CR0485 (Sexual Abuse in the First Degree [Four Counts], Unlawful Use of Electronic Means to Induce a Minor to Engage in Sexual or Other Prohibited Activities, Distribution of Obscene Matter to Minors)

  • Mr. Barrett (DOB 10/16/88) is charged in relation to alleged conduct involving a student while Mr. Barrett was a teacher at Fern Creek High School. A pre-trial conference is scheduled for June 03, 2016 at 8:30 A.M. in Division Eight of the Circuit Court. Nathan Ray Batey II is the prosecutor.

Jason Claude Mathes – 16CR1147 (Robbery in the First Degree—[Seven Counts], Assault in the Second Degree, Theft by Unlawful Taking, Fleeing or Evading Police in the First Degree, Criminal Mischief in the Second Degree)

  • Mathes (DOB 8/10/79) is charged in connection with various business robberies and one carjacking that occurred between March 30, 2016 and April 21st, 2016.  In each robbery the Defendant was armed with a firearm and in one Robbery assaulted one of the clerks who worked at one of the businesses causing injury to her head.  A pre-trial conference is scheduled for June 1st at 9:45 a.m. in Division Five. Shelly Alvey is the prosecutor.

SIGNIFICANT EVENTS

KEITH LAMONT PONDER JR., – 16CR0944 (Assault in the First Degree)

  • Mr. Ponder (DOB 3/23/93) is charged with shooting and seriously injuring clerk Tedros Dagnew at the 26th Street Liquors at 2600 Chestnut Street on March 23, 2016.  A Pretrial conference was conducted May 20, 2016. The next court date will be on July 26, 2016 in Division 9.  Elizabeth Jones Brown is the prosecutor.

TOMMY BATTON- 14CR2417 (Criminal Attempt Murder, Robbery I [Five Counts], Possession of a Handgun by a Convicted Felon, Persistent Felony Offender in the Second Degree)

  • Mr. Batton (DOB 12/3/88) is charged with numerous August, 2014, armed robberies, including at the PRP Pizza on August 11, the Rodeway Inn on August 23, and the L&N Credit Union on August 29.  A shot was fired at an employee of the Rodeway Inn during that robbery.  A suppression hearing was conducted May 16. A Jury trial is set for July 12, 2016 at 10:00am in Division 13.  Elizabeth Jones Brown in the prosecutor.

BRITTNEY BALLARD- 16CR0875 (4 counts Criminal Abuse I)

  • Ms. Ballard (DOB 11/10/95), is charged for the abuse of her son, who died in March 2016 at the age of 5 months. A Bond Hearing was to have been conducted Thursday, May 19, 2016, but it has now been scheduled to occur at the next pretrial which is is scheduled for June 28, 2016 a.m. in Circuit Court Division 1. Christie Foster is the prosecutor.

DESHON DORSEY- 14CR3330 (Murder)

  • Mr. Dorsey (DOB 12/17/87), is charged for the December 12, 2014 death of his estranged girlfriend, Porcia Mills.  A Pretrial Conference was conducted on Wednesday, May 18, 2016. The next Pretrial conference is scheduled for June 27, 2016 at 10:00a.m. in Circuit Court Division 12.  Christie Foster is the prosecutor.

 

MARK R. TATUM – 12CR1734 (Murder, Forgery in the First Degree, Wanton Endangerment in the First Degree, and Retailing against a Participant in the Legal Process).

  • Mr. Tatum (DOB 12/11/59) was convicted by a jury of his peers on May 16, 2016, of Murder, Wanton Endangerment 1st Degree, and Retaliating Against a Witness in the Legal Process. Mr. Tatum was found guilty of the May 31, 2012, shooting death of his neighbor, Mr. David Allen, in the 700 block of Gagel Avenue. The shooting was in response to charges taken out by the victim against Mr. Tatum. On May 17, 2016, the jury recommended a sentence of thirty-five (35) years in prison. Formal sentencing is scheduled for August 1, 2016 at 9:00 in Division One.  Nick Mudd and Critt Cunningham are the prosecutors.

ARRAIGNMENT

LATROY D. GASTON JR – 16CR1321 (Robbery in the First Degree [Five Counts], Burglary in the First Degree.

  • Mr. Gaston (DOB 9/22/95) has been indicted in connection with a string of robberies. The first occurred on 1/10/16; the victims were in their residence when three individuals entered the home (one armed with a handgun) and demanded money. The victim whose phone was taken was later contacted by a friend who stated that someone is using her Snapchat account on the stolen phone.  The victims provided a snapchat photo and stated that he was one of the subjects who robbed them. The defendant is complicit in four additional robberies. The case will be arraigned in Jefferson County Circuit Court Division 5 on Monday, May 23, 2016 at 10:30 pm. Josh Waldrop is the Prosecutor.

TRACELL D. NUNN – 16CR1318 (Criminal Attempt Murder of a Police Officer [Two Counts], Possession of a Handgun by a Convicted Felon, Persistent Felony Offender in the Second Degree.)

  • Ms. Nunn (DOB 11/15/88) has been indicted in connection with a May 9, 2016 police stop on a black Chrysler 300 (KY) 651-TFY at the intersection of Kramer’s Lane and Matthews Ave. The vehicle was occupied by three (3) individuals. After obtaining the information officers returned to their vehicle at which time the rear passenger exited the vehicle fleeing on foot. The defendant fired (2) shots at the officers as they continued their pursuit, the subject fled into a wooded area in the 3300 block Smith Road. K-9 “Bane” located the defendant in the wooded area in the 3300 block of Smith Road. Defendant was taken to hospital for dog bites. [Canine-Criminal-Karma for case below?] Officer recovered a Ruger .357 revolver. The case will be arraigned in Jefferson County Circuit Court Division 12 on Monday, May 23, 2016 at 3:00 pm. Ebert Haegele is the prosecutor.

HEARINGS

BRADY ADKINS AND MARCUS THORNSBERRY – 15CR2057 (Complicity to Robbery in the First Degree [Multiple Counts], Complicity to Wanton Endangerment in the First Degree [Multiple Counts], Complicity to Assault in the First Degree, Possession of a Handgun by a Convicted Felon, Cruelty to Animals in the Second Degree

  • Mr. Adkins (DOB 2/20/92) and Mr. Thornsberry (DOB 12/20/94) are being prosecuted in connection with a On June 15, 2015 incident where the defendants entered a detached garage armed with handguns and ordered everyone to the ground.  One of them then struck victim who is a juvenile in the head with the gun.  The other defendant then struggled with a victim whose father who was inside the residence. The defendant ordered the son to the ground while pointing a gun at his face.  Victim’s father ran to his bedroom and retrieved a handgun.  He and defendant exchanged gunfire.  Both defendants fled the scene before police arrived.  As one of the defendants fled he shot an unrelated neighbor’s dog twice. [The dog survived.] A suppression hearing will be conducted in Jefferson County Circuit Court Division 2 on Wednesday, May 25, 2016 at 9:30am. Critt Cunningham is the prosecutor.

TRIALS

TOYA DENISE MATHIS – 14CR1388 (Murder)

  • Mr. Mathis (DOB 02/07/1986) is charged with the murder of Thaddeus Thomas. She is charged with assaulting the victim by striking him with her vehicle in the Incredible Dave’s parking lot on May 19, 2014. Trial is scheduled for Monday, May 23, 2016, at 1:30 p.m. in Division 2 of Jefferson Circuit Court.  Alicia Gomez is the prosecutor.

SIGNIFICANT EVENTS

Damien Lacambra – 16CR1175 (Murder)

  • Mr. Lacambra (DOB 3/20/94) is charged with one count of Murder wherein he is accused of shooting his wife, Amelia Lacambra, resulting in her death.  He was arraigned on May 8, 2016 in Division 8 of the Jefferson Circuit Court.  His bond was reduced to $150,000 and a pretrial conference was scheduled for June 21, 2016 at 1:00 p.m. in Division 8.  Adrienne Henderson is the prosecutor.

HEARINGS

James Cook, Willard Fenner, and Pamela Price – 16CR0968 (Burglary II, Impersonating a Peace Officer, and Attempted Exploitation of an Adult Over $300)

  • Mssrs. Cook (DOB 4/5/1944), Fenner (DOB 1/21/1961), and Ms. Price (DOB 8/4/1977) are charged in connection with a scheme to exploit an elderly woman, Ms. Geneva Williamson, by having one or more of the Defendants impersonate a peace officer to unlawfully gain access to the home of Ms. Williamson.  A bond hearing is scheduled for Monday, May 16, 2016, at 8:45 a.m. in Division 3 of the Jefferson Circuit Court.  Ryan Olberding is the prosecutor.

Michael Cain – 16CR1185 (2 Counts of Robbery I)

  • Mr. Cain (DOB 6/17/1981) is charged in connection with the robberies of Firestone Tires at 401 E. Broadway and Long John Silver’s at 400 E. Broadway on April 27, 2016.  A hearing on a defense motion to dismiss the indictment is scheduled for Monday, May 16, 2016, at 10:30 a.m. in Division 11 of the Jefferson Circuit Court.  Ryan Olberding is the prosecutor.

PRETRIAL CONFERENCES

Keith Mario Reed – 16CR0837 (Murder)

  • Mr. Reed (DOB 4/11/1962) is charged in connection with the stabbing death of Mr. Byron Knott on March 24, 2016.  The stabbing occurred in front of 2006 Garland Avenue.  A pre-trial conference is scheduled for Monday, May 16, 2016, at 8:30 a.m. in Division 3 of the Jefferson Circuit Court.  Ryan Olberding is the prosecutor.

Jeffery Scott Jr – 15CR0847 (Attempted Murder and Assault in the First Degree)

  • Mr. Scott (DOB 12/2/86) is charged with Attempted Murder and Assault in the First Degree for a domestic violence incident which occurred on Friday, March 20, 2015, in Jefferson Memorial Forest. Mr. Scott is alleged to have struck his girlfriend multiple times in the head with a hammer causing significant and life-threatening injuries. A Pretrial Conference has been scheduled for Tuesday, May 17, at 9:15 A.M., in Division 12. The Defendant is expected to plead guilty and waive separate sentencing. Nathan Batey is the prosecutor.

Kentrey J. Moore and Terrance V. Moore, Jr – 16CR0873 (Murder, Robbery I, Possession of a Handgun By A Convicted Felon (T. Moore only), Tampering With Physical Evidence (T. Moore only), Trafficking in Marijuana (T. Moore only)

  • Defendants Kentrey J. Moore (DOB 5/18/1997) and Terrance Moore Jr (DOB 5/6/1995) are charged with Murder and Robbery in the First Degree in connection with the shooting death of Tyrone Booker, Jr on March 27th, 2016 at 331 E. Oak Street.  A Pre-Trial Conference is scheduled for Wednesday, May 18th at 8:30 a.m. in Division 7 of Jefferson Circuit Court. Shelly Alvey is the prosecutor.

Christopher L. McCullum – 15CR0968  (Murder, Wanton Endangerment in the First Degree, Tampering with Physical Evidence)

  • Mr. McCullum (DOB 2/21/72) is charged in connection with the February 21, 2015, shooting death of Mukhtar Ahmad on I-71.  A pre-trial conference is scheduled on Wednesday, May 18, 2016, at 8:30  a.m. in Division 7 of Jefferson Circuit Court.  Ryan Olberding is the prosecutor.

Terrah Love – 16CR0877 (Manslaughter in the Second Degree, Persistent Felony Offender in the Second Degree)

  • Ms. Love (DOB 09/22/87) is charged with Manslaughter in the Second Degree in relation to the death of her three month old child. Ms. Love allegedly became intoxicated on or about June 5, 2015 and slept with her child. At some point that night, Ms. Love allegedly rolled over on the child and smothered her to death. A Pretrial Conference has been scheduled for Thursday, May 19, at 9:30 A.M., in Division 13 of Jefferson Circuit Court. Nathan Batey is the prosecutor.
