The 2015 Kentucky Circuit Judge’s Judicial College is being held from Monday, September 28, 2015 through Wednesday, September 30, 2015.  As a result, there will be no criminal proceedings in Jefferson Circuit Court on those days other than arraignments.

ARRAIGNMENTS

William James Albright, 15CR2519 (Murder and Assault in the First Degree)

  • Mr. Albright (DOB 11/10/1984) is charged with the July 8, 2015 shooting death of  Cameron Pearson and the wounding of his brother Kyle Pearson.  The shootings took place in the parking lot of the mall located at 5410 Valley Station Road.  His arraignment is scheduled for Monday, September 28, 2015 at 1:00 p.m. in Division 7 of Jefferson Circuit Court.  John Balliet is the prosecutor.

Kyle R. McCoy, 15CR2497 (Rape in the Third Degree, Sexual Abuse in the First Degree and Possession of Matter Portraying a Sexual Performance by a Minor.

  • Mr. McCoy (DOB 4/2/1990), a teacher at Oldham County High School, is charged with having sexual relations during April 2015 with a 17 year old female, who was a student in one of his classes.   His arraignment is scheduled for Monday, September 28, 2015 at 1:00 p.m. in Division 8 of Jefferson Circuit Court.  Nathan Batey is the prosecutor.

PRETRIAL CONFERENCES

Kalief A. Cummings, 15CR2303 (Assault in the First Degree [two counts])

  • Mr. Cummings (DOB 12/11/69) is charged with stabbing two sisters who were in town for a bachelorette party.  The incident occurred on August 23, 2015, near Second and Liberty Street.  A pretrial conference is scheduled for October 1, 2015, at 9:00 a.m. in Division Thirteen of the Jefferson Circuit Court.  Ms. Elizabeth Jones Brown is the prosecutor.

Quincinio Canada and Dawan Mulazim, 14CR2064/15CR2029 (Robbery in the First Degree [two counts], Fleeing or Evading Police in the First Degree, Possession of a Handgun by a Convicted Felon, Persistent Felony Offender I [all charges apply to both defendants])

  • Mr. Canada (DOB 3/4/92) and Mr. Mulazim (8/14/83) are charged with robbing a Circle K employee and the man buffing the floors after-hours at the Circle K at 1000 Portland Avenue on July 25, 2014.  Officer Ed Johnson was at the intersection of Portland Avenue and 22nd Street, and was able to follow the get-away vehicle, in which the defendants fled from Officer Johnson into Indiana where they were apprehended.  The two defendants have also been charged with a series of robberies in Lexington, one of which resulted in a murder, all currently pending in Fayette County Circuit Court, and which took place in the weeks leading up to their apprehension on this Jefferson County case.  A pretrial conference is scheduled for October 1, 2015, at 9:15 a.m. in Division Thirteen of the Jefferson Circuit Court.  Ms. Elizabeth Jones Brown is the prosecutor.

Gerry Lawson, 13CR1816  (Murder, Arson in the Second Degree, Arson in the Third Degree, Wanton Endangerment in the First Degree, Cruelty to Animals, Abuse of a Corpse, and Tampering with Physical Evidence)

  • Mr. Lawson (DOB 9/30/1959)  is charged with the Murder of Vernice Aniton on March 3, 2013 at her home at 1221 Cypress Street.  Defendant Lawson is accused of setting fire to Ms. Antiton’s residence after the murder.    A pre-trial conference is scheduled for Thursday September October 1, 2015 at 9:45 a.m. in Division 2 of Jefferson Circuit Court.  Shelly Alvey is the prosecutor.

Jeffrey T. Martin, 15-CR-2325  (Distribution of Matter Portraying a Sexual Performance of a Minor (8 counts) and Possession of Matter Portraying a Sexual Performance by a Minor (20 counts)

  • Mr. Martin will appear for a Pre-Trial Conference at 9:30 in Division 10 of Jefferson Circuit Court on Friday, October 2nd.   Kentucky State Police Detective W.A. Gatson with the Electronic Crimes Branch is the lead investigator.  Courtney Straw is the prosecutor.

Brandon A. Washington and Canon Harper, 15CR2253 (Criminal Attempt Murder [Two Counts], Complicity to Assault in the First Degree [two counts] Complicity to Robbery in the First Degree, Complicity to Wanton Endangerment in the First Degree, Possession of a Handgun by a Convicted Felon [Washington Only], and Persistent Felony Offender in the First Degree)

  • Messrs. Washington (DOB 5/15/95) and Harper (DOB 10/15/95) are charged with the above listed offenses for a robbery and shooting incident that occurred on May 23, 2015, at a residence located at 1922 Portland Avenue. As a result of the shooting, one of the victims has been restricted to the use of a wheelchair and the other suffered a significant leg injury. A pre-trial for Mr. Washington is scheduled for Thursday, October 1, 2015, at 9:30 a.m. in Division Ten of the Jefferson Circuit Court. Mr. Harper has been captured in Detroit, Michigan, and is set for extradition to Louisville, KY within the next ten days.

Heather Lovy, Sonny Tweedy and Tyler Tweedy 15CR1752 (Complicity to Burglary in the Second Degree (2 counts S. Tweedy and 2 counts S. Tweedy and T. Tweedy), Burglary in the Second Degree (1 count S. Tweedy), Fleeing or Evading Police in the First Degree (1 count T. Tweedy), and Receiving Stolen Property (1 count Lovy and 1 count S. Tweedy), Tampering with Physical Evidence (1 count Lovy and T. Tweedy), Facilitation to Burglary in the Second Degree (1 count Lovy) and Persistent Felony Offender in the First Degree (1 count S. Tweedy)).

  • Father and son, Sonny Tweedy (DOB 5/2/1972) and Tyler Tweedy (DOB 11/12/1993) are charged in connection with multiple burglaries that occurred on Eastern Parkway, in Audubon Park, and the Highlands.   Two children were hiding in an upstairs bathroom during the last burglary.  The children called 911, and when the police arrived, Tyler Tweedy fled in a car, and Sonny Tweedy was apprehended after jumping out of a second floor window.  Tyler’s girlfriend, Heather Lovy (DOB 1/29/1994) was found to be in possession of more than $500 worth of belongings stolen from the Tweedys’ victims.  A pretrial conference is scheduled for October 1st at 9:00 a.m in Division 12.  Alex Gaddis is the prosecutor.

HEARINGS

Kevin Franklin, 14CR1318  (Murder, Possession of a Handgun by a Convicted Felon, and Tampering With Physical Evidence)

  • Mr. Franklin (DOB 7/31/1991) is charged for the March 10, 2014, shooting death of Nicholas Baker. Mr. Franklin is alleged to have shot Mr. Baker at the parking lot located at 12400 Parkfield Road. A Daubert Hearing is scheduled for Friday, October 2, 2015, at 1:30 p.m. in Division Thirteen. Mr. Nick Mudd is the prosecutor.

TRIAL

Kevin Michael Boyd and Thomas Edward Davidson, 13CR3242 (Complicity to Robbery in the First Degree [31 counts], Possession of a Handgun By a Convicted Felon [1 count for each], and Persistent Felony Offender In the First Degree [1 count for each].

  • Messrs. Boyd (DOB 3/12/74) and Davidson (DOB 12/11/67) are charged with the string of fifteen (15) restaurant robberies that occurred between October 23, 2013 and December 2, 2013 in the Louisville area. They were arrested after being caught in the act of robbing at gunpoint the employees of the Denny’s Restaurant located at 4030 Dutchman’s Lane on December 2, 2013.  Trial began Tuesday, September 15, 2015 at 9:00 a.m. in Division One of the Jefferson Circuit Court and is expected to continue through this week. Stacy Greive, David Erhart, and Josh Waldrop are the prosecutors.

According to the Rules of Criminal Procedure (RCr 3.02, 3.05, and 8.01), the arraignment of individuals whose case has been submitted directly to the grand jury shall take place within a reasonable time after the return of an indictment. If you are interested in a case that has been submitted directly to the grand jury, then please contact the court division in which it has been assigned to obtain the time and date of the arraignment.

ARRAIGNMENT

Alvin Borowick, Kerry Borowick, Richard Borowick, Stacey Borowick, Bargains Galore, Inc, K&R Investments, LLC, and Kentuckiana Lease Investments, Inc, 15CR2438 (Criminal Syndication (Engaging in Organized Crime), Unlawful Use or Investment of Drug Related Income, Criminal Simulation in the First Degree, Trafficking in Synthetic Drugs)

  • Mssrs. and Ms. Borowick, and the above named companies, are charged with a long term operation in which the defendants supplied large amounts of synthetic drugs to customers and local “smoke shops”.  The defendants are scheduled for arraignment on Monday, September 21, 2015 at 3:00 p.m., in Division 12 of Jefferson Circuit Court.  Frank Dahl is the prosecutor.

Jerome Ford, John Thomas Burriell, Shawn Moore, and Robert Parr, 15CR2465 (Robbery in the First Degree, Possession of a Handgun By a Convicted Felon, and Persistent Felony Offender in the First Degree (Burriel only)

  • Mr. Ford (DOB 10/24/70), Mr. Burriell (DOB 5/13/61), Mr. Moore (DOB 8/1/69), and Mr. Parr (DOB 3/26/69) are charged in connection of the robbery of Mr. Dwayne Barker wherein the Defendants are accused of violently robbing Mr. Barker when he would not relinquish his motorcycle gang vest.  An arraignment is scheduled for Monday September 21, 2015 at 9:30 in Division 2 of the Jefferson Circuit Court.  Shelly Alvey is the prosecutor.

Douglas Thomas Powell, 15CR2448 (Possession of Matter Portraying a Sexual Performance by a Minor [3 counts], Unlawful Use of Electronic Means to Induce a Minor to Engage in Sexual or Other Prohibited Activities, Illegal Possession of a Controlled Substance in the Third Degree [3 counts])

  • Mr. Powell (DOB 09/28/1952) is charged with soliciting a uncover agent online for the purpose of engaging in sexual activities and drugs with what he believed to be a fifteen year old girl. Arraignment is scheduled for September 21, 2015, at 11:00 a.m. in Division 6 of Jefferson Circuit Court. Alicia Gomez is the prosecutor.

Austin C. White, 15CR0544 (Rape in the First Degree, Sodomy in the First Degree [2 counts], Sexual Abuse in the First Degree [2 counts], Wanton Endangerment in the First Degree, Tampering with Physical Evidence, Assault in the Fourth Degree)

  • Mr. White (DOB 07/30/1969) is charged with sexually and physically assaulting a thirteen-year-old child. Mr. White was indicted on September 17, 2015 and was arraigned on September 18, 2015. The bond is set at $250,000 full cash. A pre-trial conference is scheduled for October 12, 2015 at 9:15 a.m. in Division 13 of Jefferson Circuit Court. Alicia Gomez is the prosecutor.

Gregory Alan Mathis, 15CR2458 (4 counts Promoting Sexual Performance by a Minor, 3 counts Criminal Attempt Promoting Sexual Performance by a Minor, 3 counts Unlawful Use of Electronic Means to Induce a Minor to engage in Sexual or Other Prohibited Activities, and 26 counts of Possession of Matter Portraying a Sexual Performance by a Minor)

  • Mr. Mathis (DOB 6/29/72), is charged for his contact with underage girls via internet in June and July 2015.  He is also charged for possessing pornographic material involving underage girls.  Arraignment is scheduled for Monday, September 21, 2015 at 1 p.m. in Division 8 of Jefferson Circuit Court.  Christie Foster is the prosecutor.

Kevon Taylor, 15CR2435 (Assault I – three counts; Assault II – five counts)

  • Mr. Taylor (DOB 1/1/89) is charged with the July 19, 2015, shooting at Cole’s Place at 29th and Kentucky Streets.  Eight people were struck, including a pregnant woman and her unborn baby who was delivered immediately thereafter.  Arraignment is scheduled for September 21 at 2:00 in Division 10 of Jefferson Circuit Court .  Elizabeth Jones Brown is the prosecutor.

Michael Hiser, 15CR2443 (Robbery II, Wanton Endangerment I, Criminal Mischief I – two counts, Persistent Felony Offender I)

  • Mr. Hiser (DOB 12/4/76) is charged with forcibly removing a woman from her car in a University of Louisville Hospital parking garage and driving off in it, nearly hitting a security guard and hitting a parked car, until he was apprehended in the car in Indiana minutes later.  Arraignment is scheduled for September 21 at 9:30 in Division 3 of Jefferson Circuit Court.  Elizabeth Jones Brown is the prosecutor.

PRETRIAL CONFERENCES

James Morris, 15CR0411  (Murder, Criminal Attempt Murder)

  • Mr. Morris (DOB  is charged with Murder and Criminal Attempt Murder in connection with the Murder of Shavon Ross a 16 year old female and Attempted Murder of Keijuan Scott on November 29, 2014 at 657 S. 24th Street.   A pre-trial conference is scheduled for Monday, September 21st at 9:30 a.m. in Division 1 of Jefferson Circuit Court.  Shelly Alvey is the prosecutor.

William Sexton, 15CR0938 (Robbery in the First Degree)

  • Mr. Sexton (DOB 7/14/84) is charged in connection with the March 27, 2015, robbery at Kutes Liquors in Jeffersontown. A pretrial conference is scheduled for Tuesday, September 22, at 10:15 a.m. in Division 11 of the Jefferson Circuit Court. Jennifer Murzyn Yancey is the prosecutor.

Ariana Butler, Thomas Mikels, & Lawrence Thompson, 15CR1024 (Robbery in the First Degree and Tampering With Physical Evidence)

  • Mr. Mikels (DOB 9/19/81), Mr. Thompson (DOB 10/11/79), and Ms. Butler (DOB 7/17/89) are charged in connection with the March 27, 2015, robbery at Kutes Liquors in Jeffersontown. A pretrial conference is scheduled for Tuesday, September 22, at 10:15 a.m. in Division 11 of the Jefferson Circuit Court. Jennifer Murzyn Yancey is the prosecutor.

Edward Armstrong, 12CR1033 (Theft By Failure to Make Required Disposition Over $10,000)

  • Mr. Armstrong (DOB 2/29/1960) is charged in connection with making fraudulent representations that he would construct a building for Mr. Michael Brown and intentionally failing to complete the work or return funds to the victim after receiving and negotiating two checks totaling $16,000.  This is alleged to have occurred between November 1, 2010, and March 7, 2011.  A pre-trial conference is scheduled for Tuesday, September 22nd, at 8:30 a.m. in Division 7 of the Jefferson Circuit Court.  Ryan Olberding is the prosecutor.

Stratford Young, 14CR00057 (Rape in the Third Degree and Sodomy in the Third Degree (2 counts)

  • Mr. Young (DOB 11/10/80), a Kentucky State Trooper, is charged with having sexual relations with a 15 year old female between May 22, 2013 and July 31, 2013.  A pretrial conference is scheduled for Wednesday, September 23, 2015 at 9:00 a.m. in Meade Circuit Court.  Tom Wine and Diane Arnold have been appointed as special prosecutors in this case.  Trial is scheduled for Monday, October 26, 2015.

Reginol Thomas, 15CR1567 (Murder, Assault in the First Degree [2 counts], Wanton Endangerment in the First Degree [2 counts], Criminal Mischief in the First Degree [2 counts], Illegal Possession of Synthetic Drugs, Operating a Motor Vehicle Under the Influence of Intoxicants- First offense [Aggravated Circumstances], and Persistent Felony Offender in the Second Degree)

  • Mr. Thomas (DOB 02/22/80) is charged in connection with the February 22, 2015, collision on Dixie Highway at Abbotts Beach Road that resulted in the death of his passenger Cynthia Thomas and risk of death or serious physical to two other people. A pretrial conference is scheduled for Wednesday, September 23, at 9:45 a.m. in Division 4 of the Jefferson Circuit Court. Mrs. Jennifer Murzyn Yancey is the prosecutor.

Jurmaine Henderson, 15CR0936 (Murder, Failure to Stop and Render Aid/Assistance, Wanton Endangerment in the First Degree [three counts], Operating a Motor Vehicle Without an Operator’s License, Failure to Produce Insurance Card, Operating a Motor Vehicle Under the Influence of Intoxicants- First offense [Aggravated Circumstances], Improper Turn, and Failure to Secure Child in Child Restraint Device [two counts])

  • Mr. Henderson (DOB 7/3/79) is charged in connection with the March 21, 2015, collision in the 3900 block of Seventh Street Road that resulted in the death of Mr. James Walker, III and risk of death or serious physical to three other people, including two children.  A pretrial conference is scheduled for Thursday, September 24, at 10:00 a.m. in Division 10 of the Jefferson Circuit Court. Mrs. Jennifer Murzyn Yancey is the prosecutor.

Fahed Abu Diab, Fatima Abu-Diab, Tyrone Thomas, Tony Ha, and Tobias Enix, 15CR1332 (Murder, 14 counts of Robbery in the First Degree)

  • Mr. Abu Diab (DOB  8/1/96), Ms. Abu-Diab (DOB 10/14/94), Mr. Thomas (DOB 11/10/95), Mr. Ha (DOB 12/25/95), and Mr. Enix  (DOB 10/29/98) are charged in connection with a string of 14 robberies in the Louisville area from May 1st 2015 through May 3, 2015.  During the commission of one of the robberies Scott Hunter, a Canadian citizen visiting Louisville for the Kentucky Derby, was shot and killed.  Defendant Fahed Abu Diab, Fatima Abu-Diab, and Tyrone Thomas are charged in connection with the Robbery and Murder of Mr. Hunter.  A pre-trial conference is scheduled for Thursday September 24, 2015 at 10:30 in Division 6 of Jefferson Circuit Court. Shelly Alvey and Elizabeth Jones Brown are the prosecutors.

HEARINGS

Angelo Cross, 13CR1996 (Murder and Tampering With Physical Evidence)

  • Mr. Cross (DOB 6/12/87) is charged with the Murder of Steven Bledsoe on July 15, 2013 at 3036 Greenwood Avenue.  A suppression hearing is scheduled for September 24th, 2015 at 2:00 p.m. in Division Eleven of Jefferson Circuit Court.  Shelly Alvey is the prosecutor.

Charles A. Washington and Jevon Harris-Curry, 13CR2250 (Complicity to Murder, Robbery First Degree, Burglary First Degree, Possession of a Handgun by a Convicted Felon, Tampering with Physical Evidence)

  • Mr. Washington (DOB 3/2/93) and Mr. Harris-Curry (DOB 4/18/92) are charged for the August 12, 2013, home invasion and murder of Mr. P.J. Barber. Further, the pair were assisted in their crimes by Messrs. Shakaheen O. Boyd and Timothy Cross. Messrs. Boyd and Cross have previously pled guilty for their involvement in these crimes. A hearing on pre-trial motions is scheduled for Friday, September 25, 2015, at 9:00 a.m. in Division 4 of the Jefferson Circuit Court. Nick Mudd is the prosecutor.

TRIALS

  • Mr. Miller (DOB 4/8/59) has been indicted for two sexual assaults that occurred on August 21, 2015 at Louisville Memorial Gardens Cemetery and on September 1, 2015 at Bethany Lane Cemetery.  Arraignment has already occurred.  A pretrial conference is scheduled for October 14, 2015, at 9:45 in Division 5 of the Jefferson Circuit Court. Ms. Kristi Gray is the prosecutor.

Christopher Winstead, 15CR2364 (Murder and Kidnapping)

  • Mr. Winstead (DOB 09/17/94) is charged with Murder and Kidnapping. These charges arise from the abduction and killing of Mr. Fredrick Baker which occurred on Wednesday July 8, 2015. Mr. Winstead was arraigned on September 10, 2015 in Division One of the Jefferson Circuit Court. A pretrial conference is scheduled for December 1, 2015. Mr. Ebert Haegele is the prosecutor.

Sherese Lanee Banks, 15CR2375 (Willfully Prepared False Individual Income Tax Returns)

  • Ms. Banks (DOB 7/3/75) is charged with 16 counts of willfully preparing false individual income tax returns. Ms. Banks allegedly prepared state tax returns for individuals and would submit them to the state. James R. Vinson, 15CR2367 (Arson in the First Degree and Wanton Endangerment in the First Degree [three counts])

  • Mr. Banks (DOB 2/17/82) is charged in connection with an intentionally set fire that occurred on August 30, 2015 at 4100 South Brook Street. The home was occupied by three residents at the time, including two disabled adults. Arraignment is scheduled for Monday, September 14, at 3:00 p.m. in Division Twelve of the Jefferson Circuit Court. Ms. Erin McKenzie is the prosecutor.

PRETRIAL CONFERENCE

Wayne L. Duke 15CR1067 (Murder and Tampering with Physical Evidence)

  • Mr. Wayne L. Duke (DOB 8/30/57) has been indicted for shooting death of Mr. Jonny L. Buckley III. Mr. Duke is alleged to have shot Mr. Buckley in the leg with a shotgun on April 9, 2015. Mr. Buckley succumbed to his injuries the next day. A pretrial conference is scheduled for Thursday, September 17, 2015, at 9:45 a.m. in Division Four of the Jefferson Circuit Court. Mr. Alex Gaddis is the prosecutor.

Scotty R. Johnson and Paul A. Sims 15CR1967 (Theft by Unlawful Taking Over $500)

  • Messers. Scotty R. Johnson (DOB 12/14/94) and Paul A. Sims (DOB 8/11/91) are charged with the May 12, 2015, theft of two pet dogs. The dogs and the electronic collars they were wearing were valued in excess of $1,000.00.  A pretrial conference is scheduled for Thursday, September 17, 2015, at 9:45 a.m. in Division Five of Jefferson Circuit Court. Mr. Alex Gaddis is the prosecutor.

TRIAL

Kevin Michael Boyd and Thomas Edward Davidson, 13CR3242 (Complicity to Robbery In the First Degree [31 counts], Possession of a Handgun By a Convicted Felon [1 count for each], and Persistent Felony Offender In the First Degree [1 count for each].

  • Messrs. Boyd (DOB 3/12/74) and Davidson (DOB 12/11/67) are charged with the string of fifteen (15) restaurant robberies that occurred between October 23, 2013 and December 2, 2013 in the Louisville area. They were arrested after being caught in the act of robbing at gunpoint the employees of the Denny’s Restaurant located at 4030 Dutchman’s Lane on December 2, 2013.  Trial is scheduled to begin Tuesday, September 15, 2015 at 9:00 a.m. in Division One of the Jefferson Circuit Court. Ms. Stacy Greive, Mr. David Erhart, and Mr. Josh Waldrop are the prosecutors.
